What happens if you do not pay property taxes?

Penalties and interest attach from the first missed due date, the county records a lien, and after a redemption period the county sells the property or its tax lien; in Nevada the treasurer holds the property in trust for two years after it goes delinquent, during which you can redeem it in full, and then the county can auction it.

Property tax is the one debt that outranks the mortgage, which is why lenders collect it in escrow. An owner paying their own taxes who stops paying starts a slow, well-documented process that ends in losing the home, and every step of it is recorded and mailed. The timeline is long enough to recover from and short enough that ignoring the mail is the mistake.

The first year

Nevada bills property tax in four instalments due in August, October, January and March, and a payment is delinquent ten days after each due date. Penalties run from four percent for one missed instalment to seven percent when all four are missed, with interest on top. The treasurer mails a delinquency notice, and the unpaid amount is a lien on the property from the date the tax was levied. Other states charge more (interest of one to one and a half percent a month is common) and some sell the lien to investors within the year.

The trust period and the sale

If the taxes remain unpaid, the Nevada county treasurer issues a certificate holding the property in trust for the county (NRS 361.570). The owner keeps possession and can redeem at any time during the following two years by paying the taxes, penalties, interest and costs (NRS 361.585). Roughly three years after the first missed bill, if it is still unpaid, the treasurer takes a deed and the county sells the property at a public auction, with the former owner entitled to any surplus over the debt only by claim. The mortgage lender, whose lien is wiped out by a tax sale, usually pays the taxes first and adds them to the loan, which is the more common way an owner with a mortgage actually loses the home: through the lender's foreclosure for the advance.

In states that sell tax liens rather than the property (Arizona, Florida, Illinois and others), an investor pays the tax and earns statutory interest, and can foreclose on the lien if the owner does not redeem within the period, often two to three years.

How to stop it

Pay the oldest delinquent instalment first; partial payments are accepted in most counties and stop the penalty compounding on what is paid. Ask the treasurer about a payment plan, which Clark County offers for delinquent balances. Check the exemptions: Nevada's owner-occupied abatement caps the annual increase, and veterans, surviving spouses and disabled owners have exemptions that have to be claimed. If the taxes were paid by the lender, the escrow analysis will show the advance and the repayment terms. Selling the home pays the taxes from proceeds at closing and is the clean exit if the debt is not otherwise recoverable.
