What does it mean when a house is contingent? A listing status rather than a clause: the seller has accepted an offer and at least one of the buyer's conditions is still open, so the sale can still fall apart.

Contingent is a status on a listing, not a clause in a contract. The clause is a contingency: a condition written into the purchase agreement that has to be satisfied before the sale can close. When a seller accepts an offer carrying one, the listing status changes to contingent, and it stays there until the conditions are met, waived or missed. The home is spoken for, the paperwork is real, and the sale is not done. Nothing about the word says which condition is still open or how much time is left on it, which is why two contingent listings can be a week and a month from closing.

What is open is usually one of three things and each has a date on it. The inspection contingency runs a short window, commonly seven to ten days, in which the buyer can walk or ask for repairs. The appraisal contingency runs until the lender's appraiser reports and the value clears the price. The financing contingency runs longest, to loan approval, commonly three weeks or more. A home sale contingency, where the buyer has to sell their own home first, is the slowest of the set and the one most likely to fail.

Because the deal can still end, sellers commonly keep showing the home and taking backup offers, which is what active under contract means on a multiple listing service that uses the phrase. Portals are not consistent about any of it: some show contingent for that stage and pending for the later one, and some show contingent for both. The status word is a prompt rather than an answer. The useful question for the listing agent is which contingency is still open and what date it expires on.

A worked example

A home lists at $415,000, takes an offer on day six and goes contingent. The inspection window runs 10 days, the appraisal contingency to day 21 and the loan contingency to day 28. On day 12 the buyer asks for $4,000 toward a water heater and a roof repair, the seller agrees, and the status stays contingent until the loan is approved on day 26.

What is the difference between contingent and pending?

Contingent means an offer is accepted with at least one condition still open, so the sale can still end. Pending usually means those conditions are cleared and the file is with escrow, which is later and far more likely to close. Some portals use contingent for both stages, so the status is worth confirming with the listing agent.

How long does a house stay contingent?

As long as the contingency windows run, commonly two to five weeks from acceptance, because the financing contingency is usually the last one to clear. A home sale contingency stretches it much further, since it waits on a second transaction that has its own inspection and loan.
