How does rent to own work on a house? Renting a home under an agreement that also gives you a route to buy it later, usually at a price fixed now.

A rent-to-own arrangement is two agreements stapled together: a lease, and a right to buy. The tenant pays rent, often above market, and a share of each payment plus an up-front fee is credited toward a purchase at a price the contract usually fixes on day one. If the tenant buys, the credits count. If they do not, the credits are generally gone.

The two shapes are not the same and the difference is everything. A lease OPTION gives the tenant the right to buy and no duty to. A lease PURCHASE obliges them, which means walking away is a breach rather than a decision. Read which word the contract uses before anything else.

The risks sit with the tenant. The seller keeps title through the rental period, so their mortgage, their liens and their tax bill are still attached to the house, and a buyer who cannot get financing at the end loses the premium they paid to be there. Anyone considering one should have a lawyer read it and should search the county record for what is already recorded against the property.

A worked example

A $360,000 house, a $10,800 option fee and $1,900 a month, of which $300 is credited toward the purchase, over three years. Buy at the end and $21,600 of credits plus the fee come off the price. Fail to get a loan and the $32,400 stays with the seller.

Is rent to own a good idea?

It can work for a buyer who needs time to repair credit and who has a clear route to a mortgage at the end. It goes badly when it does not: the option fee and the rent credits are usually forfeited, and the price was fixed years earlier whether the market moved up or down.

Who owns the house during a rent-to-own?

The seller. Title does not transfer until the purchase closes, so the seller's mortgage, liens and tax obligations stay attached to the property. Searching the county record before signing is the minimum precaution.
